1. Introduction
These Terms and Conditions ("Terms") govern your access to and use of the Cuugo website, mobile application, and services (collectively, the "Platform") operated by Cuugo ("we", "our", or "us").
By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Platform. We may update these Terms from time to time, and your continued use of the Platform constitutes acceptance of any changes.
2. About Our Service
Cuugo operates as an independent Australian grocery price comparison and search service, similar to Google Shopping, PriceMe and StaticICE but specialising in supermarket groceries. We let you search what Woolworths, Coles, Aldi, IGA, Costco and other retailers have in stock, and compare prices side by side across all stores simultaneously. Our Platform provides:
Grocery price comparison search engine across Woolworths, Coles, Aldi, IGA and Costco
Search what any major Australian supermarket has in stock, updated daily
Shopping list creation with real-time budget tracking and spend monitoring
Product watchlists with price drop alerts and notifications
Smart cheaper product alternative recommendations
Price history tracking to identify genuine deals
Shopping list sharing with family and friends for collaborative grocery planning
2.1 Retailer Independence
Cuugo has no commercial relationship, partnership, sponsorship or affiliation with Woolworths Group, Coles Group, Aldi Stores, IGA, Costco or any other retailer whose products or prices appear on our Platform. The use of retailer names on Cuugo is solely for the purpose of identifying the source of pricing information and is consistent with the referential use of trade marks permitted under Australian law.
Retailer names, logos and trade marks are the property of their respective owners. Nothing on Cuugo should be construed as implying any association, endorsement or authorisation by any retailer.
2.2 Publicly Available Pricing Data
All pricing and product information displayed on Cuugo is collected from publicly accessible retailer websites. Individual price points and product availability data constitute factual information not protected by copyright under the Copyright Act 1968 (Cth). Cuugo presents this information in an original, independently created format that reorganises and enhances the data to provide genuine consumer value.
We do not reproduce retailer copyright-protected content such as marketing text, editorial descriptions or creative works. Product names, sizes and prices are factual data points. Where we display product descriptions, these are independently created or enriched by our own systems.
2.3 Consumer Benefit and Competition
Cuugo's service promotes price transparency and competition in Australian grocery retail, consistent with the objectives of the Competition and Consumer Act 2010 (Cth). By enabling consumers to compare prices across multiple retailers simultaneously, we support healthy market competition and help Australian families make informed purchasing decisions. Our service directs consumers to retailer websites to complete their purchases, driving traffic and sales to the retailers whose prices we display.
2.4 Price Accuracy
While we update prices daily, prices displayed on Cuugo may not reflect real-time changes at the point of purchase. Always verify the final price with the retailer before completing your purchase. Cuugo accepts no liability for price discrepancies between our Platform and the retailer's price at the time of purchase.
3. Account Registration
To access certain features of our Platform, you must create an account. When registering, you agree to:
Provide accurate, current, and complete information
Maintain and promptly update your account information
Keep your password confidential and secure
Be responsible for all activity under your account
Notify us immediately of any unauthorised use
You may register using your email address or through third-party authentication providers (e.g., Google). You must be at least 18 years old, or have permission from a parent or legal guardian, to create an account.
4. Subscription Plans and Payments
4.1 Available Plans
Cuugo offers the following subscription tiers, available on monthly or annual billing cycles:
Cuugo Free - $0
Basic features with limited lists and items.
Cuugo Standard - $9.95/month or $99.50/year
Enhanced features including price alerts, price history, and more lists.
Cuugo Premium - $14.95/month or $134.55/year
All features with maximum limits, priority support, and ad-free experience.
Annual plans offer a discount compared to monthly billing. The specific features and limits for each tier are displayed on the subscription page and may be updated from time to time.
4.2 Payment Terms
All prices are in Australian Dollars (AUD) and include GST
Subscriptions are billed in advance on a monthly or annual basis and renew automatically unless cancelled
Payment is processed securely through Stripe, our third-party payment provider
We reserve the right to modify pricing with 30 days' notice to existing subscribers
4.3 Upgrades
You may upgrade your subscription at any time. When you upgrade:
Your new plan takes effect immediately
You will be charged for the new plan with a pro-rated credit applied for any unused time on your previous plan
You gain immediate access to all features of the new plan
4.4 Downgrades
You may downgrade your subscription at any time. When you downgrade:
Your current plan remains active until the end of your current billing period
The new plan takes effect automatically once the current billing period ends
No refund or credit is provided for the remaining time on your current plan
If your new plan has lower limits, your existing data will not be deleted but you will be unable to create new items beyond the new plan's limits
4.5 Cancellation
You may cancel your subscription at any time through your account settings. Upon cancellation:
Your subscription remains active until the end of your current billing period
Your account will automatically revert to the Free tier once the billing period ends
Your shopping lists, watch lists, and other data will be retained but access may be limited to Free tier allowances
You may resubscribe at any time to regain access to paid features
4.6 Refund Policy
Refunds are not provided for partial billing periods, downgrades, or cancellations
When upgrading, unused time on your current plan is credited towards the cost of the new plan
In exceptional circumstances, refund requests may be considered at our discretion by contacting our support team
5. Acceptable Use
When using our Platform, you agree not to:
Use the Platform for any unlawful purpose or in violation of any applicable laws
Attempt to gain unauthorised access to any part of the Platform or other users' accounts
Use automated scripts, bots, or scrapers to collect data from our Platform
Interfere with or disrupt the Platform's operation or servers
Upload or transmit viruses, malware, or other malicious code
Impersonate any person or entity, or misrepresent your affiliation
Use the Platform to compete with or harm our business
Harass, abuse, or harm other users
Share your account credentials with others
Circumvent any access controls or usage limitations
Violation of these terms may result in immediate suspension or termination of your account without refund.
6. List Sharing and Collaboration
Our Platform allows you to share shopping lists and watch lists with other users. When sharing lists:
You control who can view or edit your shared lists through permission settings
You are responsible for the content you share
Users with edit permissions can modify shared list contents
You can revoke sharing permissions at any time
7. Price Information Disclaimer
While we strive to provide accurate and up-to-date price information:
Prices may change between the time we collect data and your purchase
Prices may vary by store location
Product availability is not guaranteed
Promotional prices and special offers may have additional terms and conditions
We are not responsible for any discrepancies between displayed and actual prices
8. Intellectual Property
The Cuugo Platform, including its design, features, content, and underlying technology, is owned by or licensed to Cuugo and is protected by Australian and international intellectual property laws.
You may not:
Copy, modify, or distribute our content without permission
Use our trademarks, logos, or branding without authorisation
Reverse engineer or attempt to extract source code
Create derivative works based on our Platform
Product names, logos, and images displayed on our Platform are trademarks of their respective owners (Coles, Woolworths, Aldi, IGA, Costco, and product manufacturers). Their use is for identification purposes only and does not imply affiliation or endorsement.
9. Limitation of Liability
To the maximum extent permitted by Australian law:
The Platform is provided "as is" without warranties of any kind
We do not guarantee uninterrupted or error-free service
We are not liable for any indirect, incidental, or consequential damages
Our maximum liability is limited to the fees you paid in the 12 months preceding the claim
Nothing in these Terms excludes or limits liability that cannot be excluded under Australian Consumer Law.
10. Indemnification
You agree to indemnify and hold harmless Cuugo and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from:
Your use of the Platform
Your breach of these Terms
Your violation of any rights of another party
11. Termination
11.1 Termination by You
You may terminate your account at any time by using the account deletion feature in your settings or by contacting us. Upon termination, your access to paid features will cease at the end of your current billing period.
11.2 Termination by Us
We may suspend or terminate your account immediately if:
You breach these Terms
You engage in fraudulent or illegal activity
Your conduct harms other users or our business
We discontinue the service (with 30 days' notice)
12. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.
13. General Provisions
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Cuugo.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.
Waiver
Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
Assignment
You may not assign your rights under these Terms without our consent. We may assign our rights to any successor.
